‘Occupy’ Can Return Without Tents
NEW YORK (TheStreet) A New York Supreme Court judge ruled on Tuesday that protesters could return to Zuccotti Park, but that Occupy Wall Street could not re enter with tents and sleeping bags.
Demonstrators’ legal representation sought a court decision that would have allowed occupiers to continue camping in the park.
The protesters “have not demonstrated that they have a First Amendment right to remain in Zuccotti Park, along with thei Nike Air Max r tents, structures, generators and Nike Air Max other installations to the exclusion of the owner’s reasonable rights . or to the rights to public access of others who might wish to use the space safely,” Supreme Court Justi Nike Air Max ce Michael Stallman ordered, according to The Associated Press.
The ruling mirrored comments from New York Mayor Michael Bloomberg, who said in a statement Tuesday that the First Amendment did not give anyone the right to sleep in the park.
“There is no ambiguity in the law here the First Amendment protects speech it does not protect the use of tents and sleeping bags to Nike Air Max take over a public space,” Bloomberg said.
